Chairman Green on Shocking New ICE Data Showing More Illegal Aliens Being Ordered Removed, But Remaining on Non-Detained Docket

WASHINGTON, D.C. – Today, House Committee on Homeland Security Chairman Mark E. Green, MD (R-TN) issued the following statement after Fox News reported new ICE figures showing substantial year-over-year growth in the number of illegal aliens on Immigration and Customs Enforcement’s (ICE) Non-Detained Docket (NDD) who have been given final orders of removal by immigration judges:
“For four years, the Biden-Harris administration has hamstrung ICE’s ability to detain and remove those here illegally—even those who have been ordered to be removed by immigration judges. These devastating numbers are yet more incontrovertible proof of this reality, and should serve as a wake-up call for policymakers. It is absolutely critical that Congress fully supports the incoming Trump administration’s efforts to undo this damage and once again enforce our immigration laws and secure our borders.”

Illegal aliens who have been given a final order of removal by an immigration judge have exhausted all avenues of appealing immigration enforcement action. According to ICE figures obtained by Fox News’ Adam Shaw and Bill Melugin, the number of illegal aliens on ICE’s NDD who have received a final order of removal jumped from 1.29 million on October 1, 2023, to 1.44 million as of November 24, 2024, an increase of more than 152,000 individuals in roughly a year. Additionally, the ICE data showed the nationality of illegal aliens with final orders, and how many from each country were on the NDD. These included some stark numbers:

- Ecuador: 31,252
- El Salvador: 203,822
- Guatemala: 253,413
- Haiti: 32,363
- Honduras: 261,651
- Iran: 2,618
- Libya: 89
- Mexico: 252,044

- Russia: 3,518
- Tajikistan: 149
- Uzbekistan: 975
- Venezuela: 22,749
In November, incoming White House “border czar” Tom Homan said, “The priorities [for removal] will focus on public safety threats, national security threats and fugitives,” as well as those who “got due process at great taxpayer expense and the federal judge ordered them removed, but they didn’t leave, and they became a fugitive.”
